Update: 12th October, 2021

Today, the Judge presiding over Randy's hearing in Dallas on 14th July, recommended that Randy be given a new trial! We still have to wait for the CCA to deliver their decision, but we are hopeful.

We've come a very long way in this process and it's been a difficult road for all of us who were involved openly in the fight for Randy's life.

Randy's  dear friend and spiritual advisor, Rabbi Dan Gordon, attended the  hearing and shared with us his personal observations...

"I  was honored to be able to be present at the July 14 hearing.  I know  many would have liked to have been there, both to support Randy and to  know what’s happening. While I don’t have a legal mind, I’m happy to  relate from my perspective what I observed.
Randy  appeared in Judge Lela Mays courtroom, represented by his lawyer, Paul,  from the state, and advised by the attorneys from the federal  investigation office, Tivon and Tim.  Paul basically reiterated the  evidence that Randy did not get a fair trial because of the prejudice of  the sentencing judge. The prosecutor conceded that Judge Cunningham was  a racist, but said it did not matter because he did not act in a racist  way in this case.  Paul gave one of the best arguments I have heard (I  dare say, Talmudic) when he said that argument was like saying, “A  leopard is seen having spots on Monday and spots on Friday, but there is  no evidence that the leopard has spots that the leopard had spots on  Wednesday.
The  next step is that the lawyers are to get their written reports back to  Judge Mays who will make a recommendation to the Court of Criminal  Appeals (CCA).  If Judge Mays gives a favorable report, the CCA can  choose to accept the recommendation or not."

Update 6th April, 2020

The  Supreme Court today declined to hear Randy’s current appeal. However,  Justice Sotomayor wrote a very favourable opinion concerning Randy's  case. You can read the document here:

As  our regular visitors are aware, Randy's case is currently under review  at the Texas State Court, and we continue to wait for their decision.  Justice Sotomayor wrote a favourable review, and today's decision is not bad news by any means.

Randy's Stay of Execution!

On 4th October, 2019, Randy was granted a Stay of Execution with his case also being remanded to the convicting court for review. We will continue to post regular updates in this section, as things progress.

Some  background on Randy's case from earlier this year...On 8th July, 2019,  we had news that an execution date of 10th October had been scheduled  for Randy. This news came with the knowledge that there were pending and  unresolved issues in the Courts that Randy's lawyers worked tirelessly to bring to fruition, and the Stay being granted is the first step towards doing just that!

Details of the misconduct of Judge Vickers Cunningham was uncovered by Randy's attorneys, who then filed a Petition for Habeus Corpus, on 17th May,  2019. You can read that filing here:


The  Anti Defamation League subsequently filed a brief in Randy's case which  provides a history of anti-Semitism, and explains why terminology such  as "the f*****' Jew" and "g*******d k**e" are so offensive and cannot be  tolerated in any society. You can read the ADL Brief here:


At  the end of this post, you will also find scanned pages of a letter of  support from the Religious Action Centre Reform Judaism, in support of  Randy's case  and reinforcing what the ADL has filed.

This  was made to accompany the filing of the Amicus Brief in support of  Randy's case, prepared and signed by over 100 Jewish attorneys in Texas  (and others).

Randy's  attorneys and his friends have worked tirelessly and fought hard to  raise awareness that Randy did not have a fair and unbiased trial, and  that the judge made certain that vital and crucial evidence in Randy's  case was not allowed to be shown to or heard by the jury. The  anti-Semitic, racist, and bigotted remarks made by Judge Vickers  Cunningham are by now well known, and the fight goes on for Randy to  have a new trial.

We would like to thank Abraham  J. Bonowitz from Death Penalty Action for activating a Petition calling  for a retrial for Randy, and for getting things moving very quickly.

We  would also like to thank the Sant'Egidio Community, and Randy's  friends, Alessia and Arturo, for working together in making an urgent  appeal for Randy's life.

We  will post any further developments as they arise. In the meantime,  Randy and all of his friends wish to sincerely thank everyone for their  kindness, prayers, and support...We are overwhelmed, and it means a lot  to all of us who love him.
